AnySwap API Terms of Use

These API Terms of Use ("API Terms") govern all access to and use of the application programming interface, developer tools, documentation, keys, credentials, endpoints, SDKs, libraries, widgets, and any related software or materials (collectively, the "AnySwap API" or "API") made available by AnySwap ("AnySwap," "we," "us," "our"), operator of the non-custodial instant cryptocurrency exchange service available at anyswap.bot (the "Service").
By requesting, generating, installing, downloading, copying, accessing, or otherwise using the AnySwap API, you ("you," "your," "API User," or, where applicable, "Partner") agree to be bound by these API Terms, the AnySwap Terms of Service, Privacy Policy, and AML/KYC Policy (collectively, the "AnySwap Policies"), all of which are incorporated into these API Terms by reference. If you are entering into these API Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity, in which case "you" refers to that entity. If you do not have such authority, or if you do not agree to these API Terms in their entirety, you must not access or use the AnySwap API.
These API Terms are effective from the first day you access or use the AnySwap API.
1. Definitions
1.1. "API Key" means the unique credentials (including any API key, API secret, token, or signature mechanism) issued by AnySwap that authenticate your requests to the AnySwap API.
1.2. "Personal Access" means the default tier of API access granted to a registered account holder, subject to the restrictions in Section 3.
1.3. "Partner Access" means an upgraded tier of API access granted by AnySwap in writing, at its sole discretion, permitting business or commercial use subject to Section 5.
1.4. "End User" means any individual or entity that accesses or uses a Partner's application, website, service, or product that integrates the AnySwap API, and whose exchange transactions are initiated, routed, or executed through the Service.
1.5. "Exchange" or "Swap" means a non-custodial cryptocurrency exchange transaction executed through the Service.
1.6. "AnySwap Policies" means, collectively, these API Terms, the AnySwap Terms of Service, the AnySwap Privacy Policy, and the AnySwap AML/KYC Policy, each as amended from time to time.
2. Grant of Access; Nature of the Service
2.1. Subject to your continuous compliance with these API Terms and the AnySwap Policies, AnySwap grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the AnySwap API solely as permitted by your access tier (Personal Access or Partner Access).
2.2. AnySwap is a non-custodial service. AnySwap does not hold, store, safeguard, or control user funds, balances, wallets, or private keys at any time beyond the momentary processing required to execute an Exchange. AnySwap is not a bank, custodian, money transmitter, broker, investment adviser, fiduciary, or wallet provider, and nothing in these API Terms creates any custodial, fiduciary, agency, partnership, joint venture, employment, or franchise relationship between you and AnySwap.
2.3. All Exchanges initiated through the API — whether by you or by your End Users — are executed by and through the AnySwap Service and are governed by the AnySwap Policies.
2.4. AnySwap may change, update, deprecate, suspend, rate-limit, or discontinue all or any part of the AnySwap API at any time, with or without notice, and does not guarantee that future versions will be backwards compatible. It is your sole responsibility to monitor the "Last Modified" date above and adapt your integration to any changes. Continued use of the API after any change constitutes acceptance of the revised API Terms.
3. Personal Access (Default Tier)
3.1. By default, every API Key is issued at the Personal Access tier. Personal Access is provided strictly for personal, non-commercial use by the individual account owner only.
3.2. Under Personal Access, you may NOT:
- (a) permit any person other than the registered account owner to use, access, or benefit from your API Key or any data or functionality obtained through it;
- (b) use the API for any business, commercial, revenue-generating, or for-profit purpose, including operating an exchange aggregator, wallet, bot service, telegram/discord bot for third parties, website, application, or any product or service offered to others, whether paid or free;
- (c) resell, sublicense, rent, lease, share, publish, or redistribute API access, API Keys, or API data to any third party;
- (d) initiate, facilitate, or route Exchanges on behalf of any third party;
- (e) exceed the rate limits assigned to your API Key.
3.3. Rate limits for Personal Access are set by AnySwap at its sole discretion and may be changed at any time without notice. Exceeding your rate limits may result in temporary throttling, temporary blocking of your API Key (with escalating block durations for repeated violations), or permanent revocation.
3.4. If you require higher rate limits, expanded endpoint access, or any commercial or business use of the API, you must first apply for and obtain AnySwap's express prior written permission under Section 4. Any commercial or third-party use of a Personal Access key without such permission is a material breach of these API Terms and grounds for immediate termination without notice, without prejudice to any other remedies available to AnySwap.
4. Upgraded Access; Application and Approval
4.1. Access above the Personal Access tier — including higher rate limits, additional endpoints, or any business or commercial use — is available by permission only. You must submit an application to AnySwap (via partners@anyswap.bot or the designated partner application process) describing, at minimum: your identity and legal entity details, your intended use case, your product or service, your expected transaction volumes, your target user base and jurisdictions, and your compliance arrangements.
4.2. AnySwap may approve, condition, limit, or reject any application at its sole and absolute discretion, without obligation to disclose its reasons, methods, or criteria. AnySwap may request additional information or documentation at any time, before or after approval, and may condition continued access on your provision of such information.
4.3. Only upon AnySwap's express written approval will your API Key be upgraded to Partner Access. Until such approval is issued, your access remains Personal Access and all restrictions in Section 3 continue to apply in full. No conduct, silence, or course of dealing by AnySwap shall be construed as implied approval.
4.4. Partner Access is granted to the approved Partner only, is non-transferable, and does not extend to affiliates, subsidiaries, successors, or acquirers without a new written approval from AnySwap.
5. Partner Obligations
The following obligations apply to every Partner holding Partner Access, in addition to all other provisions of these API Terms.
5.1. Commercial Use
5.1.1. Partner Access must be used for the business/commercial purpose described in the approved application only. Any material change to the Partner's product, use case, business model, ownership, or target markets requires AnySwap's prior written consent.
5.2. KYC, Records, and User Data
5.2.1. The Partner is solely responsible for performing and maintaining Know Your Customer (KYC) verification of its End Users in accordance with all applicable laws and regulations in every jurisdiction in which the Partner operates or offers its services, and with any standards AnySwap communicates to the Partner.
5.2.2. The Partner shall collect, maintain, securely store, and keep current, for each End User and each Exchange initiated through the Partner's integration, complete records including without limitation:
- (a) End User identity and KYC verification records and supporting documentation;
- (b) device details (including device identifiers, operating system, browser/user-agent, and application version);
- (c) IP addresses and, where available, geolocation data associated with each session and each Exchange;
- (d) timestamps, transaction identifiers, wallet addresses used, amounts, and currency pairs for each Exchange;
- (e) any other information AnySwap reasonably requires for compliance, risk, fraud-prevention, or regulatory purposes.
5.2.3. The Partner shall retain such records for the period required by applicable law and, in any event, for no less than five (5) years from the relevant Exchange, and shall promptly provide such records (in whole or in part) to AnySwap upon request at any time, with or without cause, including without limitation in connection with any AML review, fraud investigation, regulatory inquiry, or law-enforcement request. AnySwap is under no obligation to justify or explain any such request. Failure or refusal to provide requested records is grounds for immediate suspension or termination of Partner Access and for AnySwap declining to execute pending or future Exchanges.
5.2.4. The Partner is the data controller (or equivalent under applicable law) for the personal data it collects from End Users and is solely responsible for complying with all applicable data protection and privacy laws in its collection, storage, transfer, and disclosure of such data.
5.3. Mandatory End User Consent and Disclosure
5.3.1. Before an End User initiates any Exchange through the Partner's integration, the Partner must, in a clear and conspicuous manner:
- (a) obtain the End User's explicit, affirmative agreement (e.g., an unticked checkbox or equivalent affirmative act — passive or bundled consent is not sufficient) to the AnySwap Terms of Service, AML/KYC Policy, and Privacy Policy, with functioning links to the current versions of each document;
- (b) clearly and prominently inform the End User that the exchange/swap is provided by and executed through AnySwap, and that the Exchange is subject to the AnySwap Policies, including AnySwap's right to hold, delay, or decline transactions and to require KYC verification directly from the End User where AnySwap's risk and AML systems so require;
- (c) inform the End User that their transaction data (including wallet addresses, IP address, and device data) may be processed by and shared with AnySwap for the purposes of executing the Exchange and complying with legal obligations.
5.3.2. The Partner shall retain verifiable evidence of each End User's consent under Section 5.3.1 and produce it to AnySwap on request.
5.3.3. The Partner shall not misrepresent, obscure, or conceal AnySwap's role in the Exchange, shall not present itself as the operator of the exchange functionality, and shall not make any representation, warranty, guarantee, or commitment on AnySwap's behalf, including regarding rates, execution times, availability, refunds, or outcomes.
5.4. Partner's Own Compliance and Sole Responsibility Toward End Users
5.4.1. The Partner is solely responsible for: its own application, website, product, and service; its relationship with, and all obligations toward, its End Users; obtaining and maintaining all licenses, registrations, and authorizations required for its business in every applicable jurisdiction; its own AML/CTF program, sanctions screening, and regulatory compliance; and all customer support, disputes, complaints, refunds, chargebacks, taxes, and liabilities arising from or relating to its product or its End Users.
5.4.2. AnySwap has no contractual relationship with, and no obligations or liability toward, the Partner's End Users except as expressly set out in the AnySwap Policies accepted directly by the End User. The Partner shall not create, and shall not represent the existence of, any obligation of AnySwap toward End Users beyond those Policies.
6. General Restrictions (All Tiers)
6.1. You shall not, and shall not permit or assist any third party to:
- (a) use the API in violation of any applicable law, regulation, sanction, contract, or third-party right, or to commit any tort or fraud;
- (b) use the API in connection with money laundering, terrorist financing, sanctions evasion, ransomware, darknet markets, stolen funds, mixing/tumbling designed to conceal illicit origin, scams, or any other illicit activity;
- (c) circumvent, disable, or interfere with rate limits, security features, risk controls, AML controls, or access restrictions of the API or the Service, including by rotating keys, accounts, or IP addresses;
- (d) scrape, harvest, cache, or mass-download data beyond what is reasonably necessary for permitted use, or use API data to build or train a competing product or dataset;
- (e) reverse engineer, decompile, or disassemble the API or the Service except to the extent such restriction is prohibited by applicable law;
- (f) introduce malware, spyware, viruses, or any harmful code, or use the API to transmit unsolicited communications;
- (g) use the AnySwap name, logo, or marks except as expressly permitted in writing by AnySwap, or in any manner suggesting endorsement, sponsorship, or partnership beyond what has been approved;
- (h) use the API on behalf of, or make it available to, any person located in, ordinarily resident in, or organized under the laws of any jurisdiction subject to comprehensive sanctions, or any person on any applicable sanctions list.
6.2. You represent, warrant, and agree that you will not violate any laws, contracts, or third-party rights, or commit any tort, by accessing or using the AnySwap API, and that you are solely responsible for all of your actions and inactions, and those of anyone using your API Key, while using the AnySwap API.
7. API Keys and Security
7.1. You are solely responsible for maintaining the confidentiality and security of your API Key and secret. All requests authenticated with your API Key are deemed made by you, and you are responsible for all activity conducted through your API Key, whether or not authorized by you.
7.2. You must notify AnySwap immediately at security@anyswap.bot upon any known or suspected compromise of your API Key. AnySwap may rotate, suspend, or revoke keys at any time for security or compliance reasons.
7.3. You must implement reasonable technical and organizational security measures appropriate to your integration, including secure key storage, transport encryption, and access controls.
8. AML, Risk Controls, and Cooperation
8.1. All Exchanges initiated through the API are subject to AnySwap's AML/KYC Policy and automated risk controls. AnySwap may, at its sole discretion and without liability, delay, hold, decline, or reverse any Exchange; require KYC verification from any End User or API User; freeze a transaction pending investigation; and report to or cooperate with regulators, law enforcement, and analytics providers.
8.2. You agree to cooperate fully and promptly with any AnySwap compliance request, investigation, or audit relating to your use of the API, including by providing the records described in Section 5.2 where applicable.
8.3. AnySwap may disclose your data and your End Users' data (including IP addresses, device data, and transaction data) to competent authorities, service providers, and compliance partners as described in the AnySwap Privacy Policy and as required by law.
9. Intellectual Property
9.1. As between you and AnySwap, AnySwap owns all right, title, and interest in and to the AnySwap API, the Service, all documentation, the AnySwap name and logo, and all associated intellectual property. No rights are granted to you other than the limited license expressly stated in Section 2.1. All rights not expressly granted are reserved.
9.2. Any feedback, suggestions, or improvements you provide regarding the API may be used by AnySwap without restriction or compensation.
10. Disclaimers
10.1. THE ANYSWAP API AND THE SERVICE ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANYSWAP EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, UPTIME, ERROR-FREE OR UNINTERRUPTED OPERATION, SECURITY, OR THAT THE API OR SERVICE WILL MEET YOUR REQUIREMENTS OR THOSE OF YOUR END USERS.
10.2. WITHOUT LIMITING THE FOREGOING, ANYSWAP MAKES NO WARRANTY OR REPRESENTATION REGARDING: EXCHANGE RATES, RATE STABILITY, OR SLIPPAGE; EXECUTION TIMES OR NETWORK CONFIRMATION TIMES; THE CONDUCT, RELIABILITY, OR SOLVENCY OF ANY BLOCKCHAIN NETWORK, PROTOCOL, LIQUIDITY SOURCE, OR THIRD-PARTY SERVICE; OR THE VALUE OF ANY DIGITAL ASSET. DIGITAL ASSETS ARE VOLATILE AND INVOLVE SUBSTANTIAL RISK OF LOSS. YOU ACKNOWLEDGE AND ACCEPT ALL SUCH RISKS FOR YOURSELF AND, IF YOU ARE A PARTNER, YOU ARE SOLELY RESPONSIBLE FOR COMMUNICATING SUCH RISKS TO YOUR END USERS.
11. Limitation of Liability
11.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANYSWAP, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR SUPPLIERS BE LIABLE TO YOU, YOUR END USERS, OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR DIGITAL ASSETS, OR FOR ANY LOSS ARISING FROM: (a) YOUR USE OF OR INABILITY TO USE THE API OR THE SERVICE; (b) ANY MODIFICATION, SUSPENSION, RATE-LIMITING, REVOCATION, OR DISCONTINUANCE OF THE API OR ANY API KEY; (c) ANY DELAYED, HELD, DECLINED, OR FROZEN EXCHANGE, INCLUDING FOR AML OR RISK REASONS; (d) ANY ACT OR OMISSION OF ANY PARTNER, END USER, BLOCKCHAIN NETWORK, LIQUIDITY SOURCE, OR OTHER THIRD PARTY; (e) UNAUTHORIZED ACCESS TO OR USE OF YOUR API KEY; (f) ERRORS IN ADDRESSES, MEMOS, DESTINATION TAGS, NETWORKS, OR AMOUNTS SUBMITTED VIA THE API; OR (g) ANY OTHER MATTER RELATING TO THE API OR THE SERVICE — IN EACH CASE WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT ANYSWAP WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANYSWAP'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE API TERMS OR THE API SHALL NOT EXCEED THE GREATER OF (a) THE TOTAL SERVICE FEES ACTUALLY RECEIVED AND RETAINED BY ANYSWAP FROM THE SPECIFIC EXCHANGE GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED US DOLLARS (USD 100).
11.3. ANYSWAP ASSUMES NO LIABILITY WHATSOEVER, IN ANY SENSE AND UNDER ANY THEORY, FOR THE PARTNER'S PRODUCT OR SERVICE, THE PARTNER'S RELATIONSHIP WITH ITS END USERS, THE PARTNER'S COMPLIANCE OR NON-COMPLIANCE WITH APPLICABLE LAW (INCLUDING KYC, AML, DATA PROTECTION, TAX, LICENSING, AND CONSUMER PROTECTION OBLIGATIONS), OR ANY CLAIM BY AN END USER AGAINST A PARTNER. THE PARTNER USES THE API AND OFFERS ITS PRODUCT ENTIRELY AT ITS OWN RISK.
11.4. Some jurisdictions do not allow certain exclusions or limitations of liability; in such jurisdictions, AnySwap's liability shall be limited to the minimum extent permitted by law. The limitations in this Section 11 apply notwithstanding any failure of essential purpose of any limited remedy and shall survive termination of these API Terms.
12. Indemnification
12.1. You agree to defend, indemnify, and hold harmless AnySwap, its affiliates, and their respective officers, directors, employees, contractors, agents, and suppliers from and against any and all claims, demands, actions, proceedings, investigations, losses, damages, liabilities, penalties, fines, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- (a) your access to or use of the AnySwap API or any breach of these API Terms or the AnySwap Policies;
- (b) your product, application, website, or service, or any content, representation, or omission therein;
- (c) any claim by or dispute with your End Users, including relating to Exchanges, KYC, refunds, data protection, or consumer rights;
- (d) your violation of any applicable law or regulation, or of any third-party right;
- (e) any failure to obtain the End User consents or make the disclosures required by Section 5.3; and
- (f) any unauthorized use of your API Key.
12.2. AnySwap reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with AnySwap's defense. You may not settle any such claim in a manner imposing any obligation or admission on AnySwap without AnySwap's prior written consent.
13. Suspension, Revocation, and Termination
13.1. AnySwap may, at any time, at its sole discretion, with or without notice, and without disclosing its reasons, methods, or criteria: suspend, throttle, downgrade, restrict, or revoke any API Key or access tier; block specific requests, endpoints, IP addresses, or integrations; or terminate these API Terms with respect to you. Grounds may include, without limitation, suspected breach of these API Terms, security or compliance concerns, legal or regulatory requirements, or risk to the Service or its users — but no grounds are required.
13.2. You may terminate these API Terms at any time by ceasing all use of the API and deleting your API Keys and any cached API data.
13.3. Upon any termination or revocation: your license under Section 2.1 ends immediately; you must cease all use of the API and delete all API Keys, secrets, and non-public API data in your possession; and, if you are a Partner, you remain obligated to retain and produce the compliance records described in Section 5.2 for the legally required retention period. Sections 5.2.3, 5.4, 6.2, 9, 10, 11, 12, 13.3, 14, and 15 survive termination.
13.4. AnySwap shall have no liability of any kind for any suspension, revocation, downgrade, or termination, including for any resulting loss of business, profits, or data, or any impact on your End Users.
14. Changes to These API Terms
14.1. AnySwap may amend these API Terms at any time by posting the updated version at anyswap.bot with a revised "Last Modified" date. It is your responsibility to review these API Terms regularly. Your continued access to or use of the API after any amendment constitutes your acceptance of the amended API Terms. If you do not agree to an amendment, your sole remedy is to stop using the API.
15. General
15.1. Entire Agreement. These API Terms, together with the AnySwap Policies and, for Partners, any written approval or partner agreement issued by AnySwap, constitute the entire agreement between you and AnySwap regarding the API and supersede all prior agreements and understandings on the subject. In the event of a conflict, a written partner agreement prevails over these API Terms with respect to Partner Access, and these API Terms prevail over the Terms of Service with respect to API-specific matters.
15.2. Governing Law and Disputes. These API Terms are governed by and construed in accordance with the laws of the Republic of Panama, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these API Terms or the API shall be submitted to the exclusive jurisdiction of the competent courts of Panama City, Republic of Panama, and you irrevocably consent to the personal jurisdiction of, and venue in, such courts and waive any objection of inconvenient forum.
15.3. Assignment. You may not assign or transfer these API Terms or any API Key without AnySwap's prior written consent; any attempted assignment in violation of this Section is void. AnySwap may assign these API Terms without restriction.
15.4. No Waiver; Severability. AnySwap's failure to enforce any provision is not a waiver. If any provision is held unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force.
15.5. No Third-Party Beneficiaries. These API Terms do not confer any rights on any third party, including End Users.
15.6. Force Majeure. AnySwap shall not be liable for any failure or delay caused by events beyond its reasonable control, including blockchain network failures, protocol forks, congestion, outages of third-party providers, acts of government, or force majeure events.

By using the AnySwap API, you acknowledge that you have read, understood, and agree to be bound by these API Terms and the AnySwap Policies.
